Terms & Conditions

Welcome to Rashmi’s Bakery! By placing an order or purchasing any product from Rashmi’s Bakery—whether through our website, phone, in-store, or any other medium—you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

1. Allergy Disclaimer & Food Safety

  • Rashmi’s Bakery is committed to maintaining a strict egg-free and nut-free environment. However, despite rigorous cleaning and handling protocols, we cannot guarantee that our products are 100% free from trace allergens or cross-contact with other potential allergens.
  • While we offer vegan and gluten-free options, our facility processes other ingredients on shared equipment. As such, our products may contain trace amounts of allergens, including but not limited to dairy, gluten, soy, and other food allergens.
  • Customers with severe food allergies or sensitivities must recognize the inherent risk of consuming any food product and assume full responsibility for their dietary choices. Rashmi’s Bakery does not accept liability for any allergic reactions, food intolerances, or health-related complications that may arise from consuming our products.
  • By purchasing and consuming our products, the customer acknowledges and accepts these risks. If you or anyone in your party has a life-threatening food allergy please exercise caution when consuming our products and consult a medical professional if you have any concerns.
  • It is the customer’s responsibility to inform all individuals consuming the product of the potential risks and seek medical advice if necessary.
  • Rashmi’s Bakery, its owners, employees, and affiliates shall not be held liable for any claims, damages, medical expenses, or legal actions resulting from allergic reactions, food sensitivities, or adverse health effects arising from our products.

2. Cake Safety Disclaimer & Warnings

Face Pushing Warning

  • DO NOT push anyone’s face into the cake. Doing so can cause serious injuries due to:
    • Hidden dowel rods, toys, decorations, fruits, or fillings inside the cake.
    • Sharp or hard decorations that may lead to cuts, choking hazards, or eye injuries.

Dowel Rods in Tiered Cakes

  • All tiered and tall cakes contain food-safe wooden or plastic dowel rods to support their structure.
  • These dowel rods must be removed before serving to prevent choking or injury.

Non-Edible Decorations

  • Some decorations on the cake are food-safe but not edible.
  • These decorations may not taste good, could pose a choking risk, and should be removed before eating.
  • Children must be supervised while consuming cakes as they may contain non-edible decorations, small pieces, or tiny sugar balls, as they may pose a choking hazard.

3. Cake Specifications & Product Variability

Cake Serving Size Guide

  • The number of servings mentioned is an estimate based on a 2” x 1.5” slice per person. The actual number of servings may vary depending on how the cake is cut—larger slices will result in fewer servings.

Handmade Cake Variations

  • The cake images shown online and in-store are for reference only. Since all our cakes are handcrafted, the final design may look slightly different. Colors, shapes, and decorations may not be exactly the same as the pictures.

Color Differences on Screens

  • Cake colors may look different in real life due to variations in screen displays and lighting conditions when photos are taken.

Short Shelf life of Fruits & Strawberries

  • Cakes with strawberries or other fresh fruits (inside or outside) should be eaten the same day, as these ingredients spoil quickly.

Availability of Toys & Decorations

  • Cake toppers, toys, and other decorations may not always be in stock. If an item is unavailable, we will use the closest possible replacement.

Dark-Colored Icing Notice

  • Icing in dark colors like black, blue, and red may have a slightly bitter taste and can stain hands and mouth. If this is a concern, you can request lighter shades or remove the colored icing before eating.

4. Cake Storage & Shelf Life

Whipped Cream Cakes

  • Must be refrigerated immediately after pickup or delivery.

Fondant Cakes

  • Must be refrigerated but also be properly covered in air tight box to prevent moisture buildup.

Cover All Products

  • To maintain freshness and prevent drying out, all products should be kept covered at all times.

Shelf Life & Storage

  • Sponge & Chocolate Cakes: Best consumed within 4–5 days after pickup/delivery.
  • Strawberries & Fresh Fruit Cakes: Should be eaten the same day, as fresh fruits spoil quickly.
  • Other Products
    • Vegetable Patties: Should be consumed on the same day. To reheat, use an oven for best results—do not use a microwave, as it can ruin the delicate puff layers.
    • Pastries, Cream Horns, Brownies, and Other Products: Must be refrigerated, stored in air tlight containers and consumed within 2–3 days for the best taste and quality.

5. Edible Images & Custom Designs

  • Edible images can be added to most cakes for an additional charge.
  • Image modifications, resizing, or enhancements may incur extra fees.
  • We can print digital images, but the quality may not be as sharp when printed on edible paper. For the best results, please provide high-resolution JPEG or PNG files.
  • Taste Notice: Edible image sheets add an extra layer on top of the cake, which may slightly alter the taste and texture.

6. Payment & Order Confirmation

  • We accept Visa, MasterCard, and American Express for online orders.
  • For in-store orders, we accept Debit, Cash, Visa, and MasterCard.
  • We do not accept personal or business cheques under any circumstances.
  • All cake orders require a full deposit (100% deposit) at the time of order placement. Orders without a full deposit will not be processed.

Order Confirmation:

  • Your order is confirmed only when a deposit is made and we have provided you with an official receipt.

7. Pickup & Delivery Policy

Order Inspection at Pickup or Delivery

  • Customers must check their order at pickup or delivery to ensure the cake is in perfect condition and all details are accurate.
  • Rashmi’s Bakery is not responsible for any damage to the product once the order has left our facility or delivery has completed.
  • If someone else is picking up the order on your behalf, ask them to carefully check the order, including:
    • Spelling of any messages on the cake.
    • Colors and design details.
    • Total number of items in the order.
    • Any special instructions or modifications requested.
  • To help them verify, you can send them a text with order details or a link to the receipt.
  • It is much easier to fix any issues while the order is still at the bakery, so please double-check before leaving.

Delivery Policies

  • If you choose delivery, please ensure that someone is available to receive the order. We are not liable for orders left unattended.
  • In most cases, we call recipients to confirm their availability, so we are unable to send surprise gifts unless you guarantee that the recipient will be available.

Delivery Timing & Planning

  • Toronto and surrounding areas have unpredictable traffic congestion. All orders will be delivered on your chosen delivery date, but we cannot guarantee an exact time.
  • Delivery time window:12:00 PM – 7:00 PM.
  • If you need your cake before a specific time, we strongly recommend selecting delivery for the day before.
  • Our cakes stay fresh for 4-5 days in the refrigerator, so receiving them a day in advance will not affect quality.

8. Order Processing & Last-Minute Orders

  • We accept last-minute orders, including wedding cakes, subject to availability. However, during peak seasons, weekends, and holidays, our schedule may be fully booked, and we may not be able to accommodate all requests.
  • To guarantee availability, we strongly recommend placing orders as early as possible, especially for custom cakes or large orders.

Order Confirmation & Responsibility

  • Customers are responsible for reviewing all order details carefully before confirming and making payment. This includes:
    • Spelling of any messages on the cake.
    • Colors and design details to ensure they match your expectations.
    • Total number of items in the order.
    • Any special instructions or modifications requested.
  • Changes to orders may not be possible after confirmation, especially for same-day or next-day orders.

Rush Orders & Limitations

  • Rush orders may have limited design and customization options, as some decorations require time to prepare.
  • Certain cakes, such as fondant cakes, tiered cakes, and custom edible images, require longer preparation time and may not be available for last-minute requests.

9. Cancellation & Refund Policy

Cancellation Policy

We understand that plans may change, and we strive to accommodate cancellation requests whenever possible. However, since all our cakes are made to order, cancellations depend on whether work has begun on your cake.

  • Single-Tier Cakes: Cancellations are allowed up to 5 days before the scheduled pickup or delivery date.
  • Wedding & Tiered Cakes: Cancellations are allowed up to 7 days before the scheduled pickup or delivery date.
  • If a cancellation request is made after the above timeframes, we may approve it only if no work has started on the cake.
  • Work on your cake may begin several days before pickup/delivery, depending on the complexity of the design. Once any work has begun (including baking, custom decorations, or edible images), a refund may not be possible.

Our goal is to provide an amazing customer experience, and we will always try to assist within our cancellation policy.

Refund Policy

  • Unable to Refund any products because:
    • Food Safety Regulations: Once a cake or any other baked item leaves our facility, we cannot accept returns due to strict food safety laws and hygiene standards.
    • Preventing Cross-Contamination: Since most of our cakes are egg-free, nut-free, vegan, and gluten-free, we have strict protocols to maintain a safe environment for customers with dietary restrictions and allergies. Returning products could pose a serious health risk because we cannot guarantee that the cake has not been exposed to outside contaminants, allergens, or improper storage conditions after leaving our facility. Even if the cake looks untouched, any exposure to allergens or non-certified environments increases the risk of cross-contamination, which is why we cannot accept returns.
    • Integrity of Our Products: Our goal is to ensure that every customer receives a product that is safe and fresh. Allowing returns could compromise the quality assurance we maintain for all customers.

Quality Concerns

  • We Stand By Our Products: If you have any concerns about the quality of your cake or any other product, please reach out to us immediately.
  • We Will Work With You: Whether it’s a concern about taste, texture, freshness, or appearance, we will listen carefully and work with you to find a suitable resolution.
  • Contact Us Promptly: To ensure we can address your concern effectively, please report any issues as soon as possible after pickup or delivery.

10. Complaints & Dispute Resolution

Corrections & Minor Repairs

  • Small adjustments, such as inscription mistakes or minor design corrections, can often be fixed immediately.
  • Customers must bring the cake to our bakery for any corrections. We are unable to visit the customer’s location to make fixes.
  • To allow us the best opportunity to assist, customers must report any issues as soon as possible after receiving their cake.

Complaint Handling & Resolution

At Rashmi’s Bakery, we are committed to delivering high-quality cakes and baked goods, and we take all complaints seriously. Our goal is to work with you to resolve any issues to your satisfaction while also being fair to our business.

  • Careful & Professional Handling: We approach all concerns with care and professionalism to ensure a fair resolution.
  • Investigation Process: Some complaints may require further investigation, such as:
    • Verifying order details to ensure accuracy.
    • Checking preparation and handling processes to identify any issues.
    • Reviewing photos or other evidence if necessary.
  • Resolution Timeline: Since every situation is unique, an immediate resolution may not always be possible. However, we will keep you informed throughout the process and strive to resolve the matter as quickly as possible.
  • Fair & Balanced Approach: While we aim to ensure customer satisfaction, we must also be fair to our business by considering factors such as order accuracy, handling after pickup/delivery, and any external circumstances affecting the product.

If you have any concerns, please contact us as soon as possible, and we will do our best to work with you toward a reasonable and fair resolution.

Liability & Compensation

  • Maximum Liability: Rashmi’s Bakery’s total liability for any claim shall not exceed the price paid by the customer for the cake or other products in question.
  • No Additional Compensation: We do not provide refunds, reimbursements, or compensation beyond the original purchase price, including but not limited to inconvenience, emotional distress, events impacted, or third-party costs incurred as a result of an issue with the order.

11. Privacy & Data Protection

Rashmi’s Bakery is committed to protecting customer privacy and ensuring secure transactions.

  • We collect only the necessary information required to process orders, including names, contact details, and payment information.
  • Payment transactions are processed securely through third-party payment processors, and we do not store full credit card details.
  • Customer information is never sold, rented, or shared with third parties for marketing purposes.
  • By placing an order, you consent to our collection and use of information as outlined in our Privacy Policy.

12. Force Majeure Clause

Rashmi’s Bakery shall not be liable for any failure or delay in fulfilling orders due to circumstances beyond our reasonable control. These may include, but are not limited to:

  • Natural disasters, extreme weather, fires, floods, or pandemics.
  • Transportation disruptions, supply shortages, or ingredient unavailability.
  • Power outages, system failures, or acts of government that impact business operations.

If an order is affected by such an event, we will notify customers as soon as possible to offer an alternative solution. In such cases, our maximum liability is limited to a refund of the amount paid by the customer for the affected order. Rashmi’s Bakery shall not be responsible for any additional compensation, including but not limited to inconvenience, emotional distress, or third-party costs incurred as a result of the delay or cancellation.

13. Intellectual Property Rights

  • All cake designs, images, branding, and marketing materials displayed on our website or social media are the intellectual property of Rashmi’s Bakery.
  • Customers or any other person may not reproduce, distribute, or use these designs for commercial purposes without prior written consent.
  • Custom cake designs requested by customers remain the exclusive property of Rashmi’s Bakery. We reserve the right to photograph, reproduce, and use these designs for promotional purposes, including but not limited to our website, social media, advertisements, and marketing materials, at our sole discretion.

14. Gift Cards & Promotional Discounts (if applicable)

  • Gift cards are valid for a specified period and cannot be redeemed for cash.
  • Promotions, discounts, or special offers may have specific terms and expiration dates, which will be clearly stated at the time of the offer.
  • Discounts cannot be combined unless explicitly stated.

15. Acceptance of Terms

By placing an order or purchasing any product from Rashmi’s Bakery—whether through our website, phone, in-store, or any other medium—you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

Policy Updates & Changes

  • We reserve the right to update, modify, or change these Terms & Conditions at any time without prior notice.
  • The most recent version will always be available on our website, and it is the customer’s responsibility to review the terms before placing an order.

Liability Disclaimer

  • Rashmi’s Bakery is not liable for any damages, losses, or expenses arising from the consumption, handling, or transportation of our products once they leave our facility.
  • Customers are responsible for proper storage and handling of their cakes and baked goods to maintain quality and safety.
  • While we take great care to maintain a controlled environment, we cannot guarantee an allergy-free facility, as our products are made in a bakery that also processes allergens, including gluten, dairy, and soy, even if they are not included in the specific product ordered.

Dispute Resolution, Mediation & Arbitration

At Rashmi’s Bakery, we strive to provide an excellent customer experience and resolve concerns in a fair and professional manner. If a dispute arises, we encourage open communication to reach a resolution.

  • Initial Resolution Attempt: Customers agree to first contact Rashmi’s Bakery directly to attempt to resolve any concerns in good faith before taking further action.
  • Mediation Requirement: If a resolution is not reached, both parties agree to engage in mediation with a neutral third party before proceeding with legal action. Mediation costs will be shared equally unless otherwise agreed.
  • Binding Arbitration: If mediation does not result in a resolution, any unresolved disputes shall be settled through binding arbitration, rather than litigation, except where prohibited by law. Arbitration will be conducted in accordance with the rules of a recognized arbitration organization.
  • Jurisdiction & Governing Law: Any disputes, claims, or legal matters shall be governed by the laws of Ontario, Canada, and all arbitration or legal proceedings shall take place within the appropriate jurisdiction.
